By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service.

These Terms constitute a legally binding agreement between you ("User", "you", "your") and Salamtak GmbH.

Salamtak provides an AI-powered platform that connects international patients with German medical facilities. Our services include:

• Medical Document Analysis: AI-powered analysis of medical records to extract relevant information and ICD codes
• Hospital Matching: Matching patients with suitable German hospitals and specialists based on medical expertise, quality reports, and treatment outcomes
• Digital Patient Files: Creation of comprehensive, anonymized digital patient files for German healthcare providers
• Communication Facilitation: Facilitating communication between patients and German medical facilities
• Multilingual Support: Providing support in English, German, Arabic, Russian, and French through our chatbot "Sara"
• Visa and Travel Assistance: Providing information and assistance regarding visa requirements and travel arrangements (where applicable)

3. No Medical Services - Critical Disclaimer

IMPORTANT: Salamtak GmbH is NOT a medical service provider and does NOT provide medical services, medical advice, diagnosis, or treatment.

Our platform serves exclusively as an intermediary and technology service that connects patients with qualified medical professionals in Germany. We do not:

• Offer medical consultations, advice, or recommendations
• Diagnose medical conditions or diseases
• Prescribe treatments, medications, or therapies
• Provide emergency medical services
• Replace or substitute the relationship between patients and their healthcare providers
• Guarantee any specific medical outcomes or results

All medical decisions must be made in consultation with qualified, licensed healthcare professionals. The information provided through our platform is for informational and organizational purposes only.

4. User Eligibility and Account

To use our Service, you must:

• Be at least 18 years of age or have parental/legal guardian consent
• Have the legal capacity to enter into binding contracts
• Provide accurate, complete, and current information
• Not be prohibited from using our services under applicable law

If you are submitting information on behalf of another person (e.g., a relative), you represent that you have the legal authority to do so.

Salamtak GmbH shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to:

• Medical outcomes, complications, or adverse events
• Decisions made by healthcare providers or medical facilities
• Delays, cancellations, or failures in communication with medical facilities
• Errors or inaccuracies in AI-generated analysis or matching
• Loss of data, profits, revenue, or business opportunities
• Technical issues, system failures, or service interruptions
• Actions or omissions of third-party medical providers
• Unauthorized access to or alteration of your data

8.3 Maximum Liability

In no event shall Salamtak GmbH's total liability to you for all claims arising from or related to the Service exceed the amount you paid to Salamtak in the twelve (12) months preceding the claim, or €100, whichever is greater.

8.4 Exceptions

Nothing in these Terms shall limit or exclude our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded or limited under applicable law

9. Indemnification

You agree to indemnify, defend, and hold harmless Salamtak GmbH, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of third parties
• Your provision of false, inaccurate, or misleading information
• Any medical decisions or outcomes related to your use of the Service

10. Third-Party Services and Links

Our Service may contain links to third-party websites, services, or medical facilities. We are not responsible for:

• The content, accuracy, or availability of third-party websites
• The quality, safety, or outcomes of services provided by third-party medical facilities
• The privacy practices or terms of service of third parties

11. Intellectual Property Rights

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof (collectively, "Content"), are the exclusive property of Salamtak GmbH or its licensors and are protected by:

• German and international copyright laws
• Trademark laws
• Patent laws
• Trade secret laws
• Other intellectual property rights

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. You may not:

By uploading medical documents, images, or other content to our Service, you grant Salamtak GmbH a worldwide, non-exclusive, royalty-free license to:

• Create anonymized or pseudonymized versions for research and improvement purposes
• Share relevant information with matched medical facilities

You retain all ownership rights to your content. We will handle your content in accordance with our Privacy Policy and applicable data protection laws.

13. Termination and Suspension

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Provision of false or misleading information
• Non-payment of fees
• Abusive or harmful behavior

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and data, subject to legal retention requirements
• Provisions of these Terms that by their nature should survive termination shall survive

21. Force Majeure

Salamtak GmbH shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

22. Language

These Terms are provided in English. In the event of any conflict between the English version and any translation, the English version shall prevail.
